Visual Evidence in UDRP Cases: Capturing and Preserving Web Pages

1. What web-page evidence can show in a UDRP case
WIPO describes three UDRP elements: rights in a trademark and identity or confusing similarity; the respondent’s lack of rights or legitimate interests; and registration and use in bad faith. A web capture is most useful when you explain the specific factual proposition it supports, rather than submitting an image without context. WIPO’s current domain-name disputes guidance advises parties to provide evidence supporting the applicable elements and gives screenshots of the offending website, fraudulent emails, and prior correspondence as examples.
For example, a dated screenshot might help show the page’s appearance, branding, products, or apparent purpose at the time it was captured. It cannot by itself establish every relevant fact, such as who controlled the domain, the registrant’s intent, or when the content first appeared. Connect each capture to the relevant allegation and corroborate it with other available records where appropriate.
WIPO Overview 3.0, the 2017 edition now superseded by Overview 3.1, described dated screenshots of the site to which a disputed domain resolves as one form of available evidence for certain bad-faith allegations. Use the current Overview 3.1 announcement and current guidance for present positions; treat the older wording as historical context.
2. Capture a dated screenshot and preserve its provenance
- Identify the exact page. Record the full URL, including path and relevant query parameters. Note whether you reached it directly or through a redirect, and capture relevant intermediate or resulting pages when needed.
- Capture promptly and record the circumstances. Note the date and time with time zone, the operator, browser or tool, and any settings or actions needed to reproduce what appeared. If a consent banner, pop-up, login, or other page state matters, record that state rather than silently removing it.
- Keep the original intact. Retain the unaltered capture. If you make a cropped, annotated, converted, or redacted copy for an exhibit, identify it as a derivative and keep the original separately.
- Capture enough context. Include the address or other context that helps identify the page and take separate captures for important page states that one image cannot show. Preserve related emails, correspondence, and other records.
- Log and label the evidence. Assign each file an exhibit identifier and keep a short log connecting it to its URL, timestamp and time zone, method, operator, and relevant proposition.
- Check filing directions. Confirm the provider’s current supplemental rules, file formats, size limits, and submission instructions for the actual case.
This workflow is prudent recordkeeping, not a WIPO-mandated capture protocol. WIPO’s materials support dated screenshots as an evidence example but do not prescribe one universal tool or authentication method.
3. Screenshot, WARC, and Wayback: what each preserves

ISO 28500:2017 specifies the WARC format for web-archive payloads, control information, linked metadata, and data-integrity support; ISO says the edition was confirmed in 2023. Where the page’s appearance is central, use a screenshot for readability. Where linked resources, protocol details, or a revisit-able harvested record matter, preserve a WARC-capable capture too. Keeping both can make the visual exhibit easy to understand while retaining more underlying context.
4. Make the record understandable to a panel
- Give every file a descriptive name and exhibit identifier; keep a separate capture log.
- State what the capture shows, when and how it was obtained, and which allegation it supports.
- Distinguish your own contemporaneous capture from a public archive record, and identify the latter’s displayed timestamp and source.
- Explain gaps or unusual states, such as redirects, unavailable resources, a login wall, or a banner covering page content.
- Keep originals and derivative exhibit copies traceable to one another.
- Follow the case provider’s current filing requirements and directions.
WIPO says panels may conduct limited research into public records when it is useful to deciding a case, with historical resources such as the Internet Archive as an example.
